General Terms and Conditions – Loopi Business GmbH

These General Terms and Conditions (GTC), in the version valid at the time of the order, apply to all deliveries of goods and services provided by Loopi (a company of Loopi Business GmbH, 6300 Zug) (“Loopi”). Customers place orders via the online shop www.loopi.ch or in written form (including but not limited to email, website contact form, or postal mail). By submitting an order, the customer explicitly agrees to these GTC. Deviating agreements require written form to be valid. The offer applies while stocks last. Any customer terms that contradict these GTC are invalid.
The subscription contract is concluded between:

and the customer.
The contract covers Loopi’s product-service system and the associated delivery of products such as strollers, stroller accessories, and travel cots for use (usage rights).
Loopi offers various baby and children’s products on a subscription (rental) basis. The customer selects the desired products via the online shop and receives them at the agreed delivery time. For the contractual duration, the customer receives a personal, non-transferable right to use the leased products. Products may only be leased for personal use and may not be resold. The customer cannot purchase the products after the end of the subscription. At the end of the subscription contract, all products must be returned completely and in proper condition. The products remain at all times the exclusive property of the manufacturer (as per Section 13).
Loopi’s services are subject to a monthly subscription fee, which must be paid by the customer (Section 7.2).
Information provided in the online shop does not constitute a legally binding offer, but an invitation for the customer to submit a binding order (offer). The customer's order constitutes a binding offer to conclude the contract. Loopi accepts this offer through the online order confirmation or any form of written confirmation. Loopi may reject any order without giving reasons. By confirming the order via button click, the customer agrees to the GTC and rental terms and enters a binding rental contract, which may only be terminated after the minimum contractual period.
The customer confirms that all information provided is true, complete, and verifiable. They also confirm that entering into the subscription will not create over-indebtedness or any obvious default risk for the monthly payments. The customer must update their data in their user account when changes occur. Updates can be made online after initial registration. Loopi stores the customer’s data in compliance with data protection laws, using it for order processing, invoicing, and credit checks.
Either party may terminate the contract with 14 days’ notice to the end of a subscription month (based on the product’s delivery date), but not before the minimum term (3, 6, 12, or 24 months). If no minimum term option exists, a 6-month minimum applies. Early contract termination is only possible as per Section 14. Returning the product before the final day of a subscription month does not shorten the contract or reduce the monthly fee.
Termination must be submitted through the website’s self-service center. The subscription ends once the customer cancels within the contract period and returns all products within that period.
If the customer uses multiple Loopi services/products, they must specify exactly which ones are being cancelled. Termination does not entitle the customer to any refund of fees.
Subscription prices are determined by Loopi and published on www.loopi.ch. The price valid at the time of order applies.
Loopi may adjust prices and will notify customers by email. Agreed prices remain valid for the minimum term or until the next possible termination date.
Monthly subscription fees include:
– Use of the respective product(s)
– All maintenance, service and repairs, unless caused by improper customer use
After contract conclusion, products are shipped according to the customer’s configuration and delivered for the agreed period. Loopi strives to deliver at the earliest declared date or the customer’s preferred date, whichever is later. Delivery area: Switzerland and Liechtenstein.
Loopi covers packaging costs for shipping. For returns, the customer must reuse the original carton (see Section 11 “Returns”).
Loopi offers payment via credit card (Visa, MasterCard) or TWINT. A valid payment method is required. Loopi may require a verifiable billing address, credit limit, creditworthiness, prepayment, or security deposit.
Creditworthiness data is provided by CRIF AG, Zurich. Loopi assumes no liability for accuracy. Questions must be directed to CRIF AG.
If the billing address cannot be verified or creditworthiness indicates risk, Loopi may require the customer to:
Provide a security deposit equal to the product’s purchase value (refunded after contract end), or
Have a guarantor with good creditworthiness take over the subscription, or
Withdraw from the contract by paying a cancellation fee equal to one month’s rent
If the customer does not choose an option within 14 days after subscription start, option 3 applies automatically.
Subscriptions run for at least 6 months and then renew monthly. Monthly fees are invoiced each month. The first fee is due upon subscription start.
The customer must contest any credit card or TWINT charge within 30 days; otherwise it is deemed accepted. Uncontested claims may be offset.
If the customer defaults, Loopi may suspend services without notice or terminate the contract immediately and reclaim all products. Loopi may use collection agencies or sell claims.
Additional fees:
– Address investigation CHF 25
– Reminder notice CHF 30
– Debt collection: actual costs
– Violations: immediate return required; if not returned within 14 days, the customer is charged the product’s purchase price
– Independent expert opinion CHF 800 (customer pays)
Loopi transfers customer data to Lixt AG, 6340 Baar, for unpaid debts. Debt collection fees apply according to claim amount, plus official fees.
Loopi provides both new and pre-used products. All are in “as-new” condition.
All products undergo thorough testing, maintenance, repairs, and professional cleaning before dispatch. Customers must inspect products upon arrival and report defects within 72 hours by email (abo@loopi.ch), using the provided checklist. If no report is made, products are considered defect-free.
The customer bears the burden of proof for defects existing at delivery.
The customer must use the products carefully and according to the manufacturer’s instructions.
Warranty is void if instructions are not followed or if defects arise from improper use, storage, or handling. Minor deviations from advertised characteristics do not justify warranty claims. Normal wear is excluded. Warranty claims are non-transferable.
Loopi may charge the product’s value if damage results from improper handling and was not pre-existing or properly reported.
Examples:
– Burn holes, mold, pet scratches
– Intentionally torn fabrics
– Shrinkage from incorrect washing
– Bleaching damage
– Heavy pet odor/hair
– Slashed tires
– Torn stroller basket due to overloading
– Bent frame parts
– Persistent smell of smoke or animals
The customer must report damage or loss immediately (abo@loopi.ch). The customer is liable for all damage from falls, vandalism, weather, transport, misuse, or third-party use.
In case of theft or loss, the customer is liable and Loopi may charge the product’s full retail value.
Products must be adequately insured. Customers are advised to include them in their household insurance and add “simple theft away from home.” Theft requires a police report and proper security (e.g., lock).
Returns must be requested through the customer account. Loopi schedules a Swiss Post pickup at the customer’s home. The customer must specify return date, address, drop-off location, and contact person. Loopi covers return costs.
Unsuccessful pickups (e.g., items not placed at agreed location) may be charged to the customer.
Original packaging must be reused. If not available, a replacement can be purchased.
Returns are checked for completeness and quality; missing items may be charged.
Product changes during the minimum term are not possible.
After switching products, a new minimum term starts; previous rental duration cannot be credited.
After the minimum term, customers may switch to a different stroller model. The current stroller must be cancelled in the self-service center and the new one ordered on the website.
Products remain the exclusive property of the manufacturer (Bugaboo International B.V.; Qeridoo GmbH; Holzhelden GmbH; Kluba Medical GmbH) or private owners.
Loopi provides the services (Section 2) and grants usage rights.
If a customer purchases a product, ownership transfers fully to them.
Either party may terminate the contract immediately for cause. A material breach includes:
– Payment default > 30 days
– Bankruptcy proceedings
– Improper product use
– Breach of customer obligations
– Legal violations that could harm Loopi’s reputation
If the products do not meet the customer’s expectations, the contract may be terminated at the next possible termination date (Section 5.2).
If individual provisions are invalid or incomplete, the remaining provisions remain in force. Invalid provisions are replaced by the closest valid alternative.
Swiss law applies. Jurisdiction is Zug, Switzerland. Loopi may also sue at the customer’s domicile. Mandatory legal jurisdictions remain reserved.
Changes to contractual terms require mutual agreement and written form.
